Bergenfield Borough Council voted to table three proposed property ordinances after more than two hours of discussion with residents at its October 6 meeting.

The ordinances, numbered 26-2676, 26-2677 and 26-2678, address residential setbacks, occupancy certificates and off-street parking requirements. Council members agreed to postpone any vote until a future meeting.

Details of the proposed ordinances

Ordinance 26-2676 would prohibit air conditioning units, heat pumps, generators, pool equipment, EV chargers, window wells, steps and covered patios from required side-yard setbacks. Ordinance 26-2677 would require a new owner or tenant to obtain a certificate before occupying a property, including submission of a survey no more than five years old and payment of additional fees. Violations could result in fines up to $1,000 or up to 30 days in jail. Ordinance 26-2678 would adjust the formula used to calculate required off-street parking spaces, potentially affecting homeowners seeking to add bedrooms or builders working on smaller lots.

Resident concerns and borough response

Members of Bergenfield Homeowners for Fair Zoning and other residents spoke against the measures, citing added costs and reduced usability of properties. Borough officials said the ordinances were developed to address quality-of-life and public safety issues, including obstructed access for first responders. The borough presented photographs of items placed in side yards and examples of property conditions it seeks to regulate.

Borough Administrator Corey Gallo stated at the meeting that development will continue and that the goal is to ensure it occurs responsibly. The meeting was attended by Borough Attorney John Schettino, Mayor Arvin Armatorio and Gallo.
